Dr. Ichak Adizes and the Corporate Lifecycle

At the foundation of effective management for any organization is the fundamental truth that all organizations, like all living organisms, have a lifecycle and undergo very predictable and repetitive patterns of behavior as they grow and develop. At each new stage of development an organization is faced with a unique set of challenges. How well or poorly management addresses these challenges, and leads a healthy transition from one stage to the next, has a significant impact on the success or failure of their organization.

Leading an organization through lifecycle transitions is not easy, or obvious. The same methods that produce success in one stage can create failure in the next. Fundamental changes in leadership and management are all required, with an approach that delicately balances the amount of control and flexibility needed for each stage. Leaders who fail to understand what is needed (and not needed) can inhibit the development of their companies or plunge them into premature aging.

The challenges that every organization must overcome at each stage of development first manifest themselves as problems that arise from the growth and success of the company and from external changes in markets, competitors, technology and the general business and political environment. This simple, unavoidable reality leads to the following five important insights about the nature of problems in organizations.

  1. Problems are normal and desirable. Problems are the natural result of change. The only place on the lifecycle curve where there are no problems is the place where there is no change, which is Death. If you think that good managers are those whose organizations have no problems, think again. Your reward for successfully resolving the problems that confront you today, is a set of new problems tomorrow that will be larger and more complex. If your company faces a high rate of change in your markets, technology or industry, your challenge is magnified. The faster the rate of change, the faster problems appear and grow.
  2. Your role as a leader is not to prevent problems or slow the pace of change. Instead, focus on accelerating your organization's ability to recognize and resolve problems. Your ability to work together as a team and quickly tackle any and all situations, or decide not to, is your ultimate competitive advantage.
  3. Some of the problems you face are normal and some are abnormal. Normal problems are those that are expected for a given lifecycle stage. Abnormal problems are those that are not expected (or desirable) in a stage of the lifecycle. Since you will never have enough time or resources to address all the problems you face, focus on abnormal problems. Many normal problems can be ignored since they tend to resolve themselves during the natural course of growth and development.
  4. You can drive your organization faster when you know the road ahead. Most of the issues you face are common to all organizations. There is no need for you to reinvent the wheel. You can save a lot of time and effort by thoroughly understanding the nature of all 10 stages in the lifecycle, and knowing what it takes to transition from one stage to the next. If you and your management team share a common understanding of this knowledge before problems arise, it will also help you attack the problems, instead of attacking each other.
  5. Prime is the Fountain of Youth for Organizations. One key difference between the lifecycle for human beings versus organizations is that living things inevitably die, while organizations need not. The "age" of a company in terms of its lifecycle is not related to its chronological age, the number of employees, or the size of its assets. Instead, the lifecycle age is defined by the interrelationship between flexibility and control. There is a fountain of youth for organizations called Prime. An organization that is in Prime has achieved a balance between control and flexibility. A Prime organization knows what it is doing, where it is going, and how it will get there. It also enjoys both high growth and high profitability. Once an organization reaches Prime, leadership must work to sustain that position.

Management Systems in Shipping - What about QRM?

Having been always an eager student myself and using the opportunity that at present I am lecturing in Maritime Transport Management at Odessa National Maritime Academy, I try to find new effective tools and approaches in management for Shipping. Though there are many systems available and as well many training courses in them, there are not so many success stories and case studies of implementing the systems in the Maritime Industry.

My efforts are to show to the students ways how one would port recommended management tools into a Port Agency, Shipping Line, Shipmanagement Company.

One of the tools is called Quick Response Manufacturing. I believe its application has the future in Shipping, i.e. in services.

Foreign flags allowed into Ukrainian inland waterways

Feb 29, 2012, Ukrainian government signed decree allowing foreign flag vessels (particularly yachts, sailing and passenger vessels) to enter inland waterways of Ukraine. For the cargo ships it depends on the colours they fly.

In case the Flag State has no bilateral agreement with Ukraine for the inland waterway access, such an entrance can be still allowed on the single permit basis.

Ingress volumes - how much water flows into a damaged compartment

SOLAS CH II-1 Regulation 19 requires that each ship to be provided with the damage control information. Very often it is a thin file with the general arrangement plan showing boundaries of the watertight compartments with the openings and their means of closure, position of controls thereof, arrangements for the correction of any list due to flooding; watertight doors arrangement, general and specific precautions considered by the Administration to be vital to the survival of the ship, passengers and crew (i.e., closures, security of cargo, sounding of alarms, etc.).

Frankly speaking, on some ships I found it of just an illustrative use.

The same regulation says:
In case of ships to which damage stability requirements of part B-l apply, damage stability information shall provide the master with a simple and easily understandable way of assessing the ship's survivability in all damage cases involving a compartment or group of compartments. 

"simple and easily understandable way" - unfortunately I have never seen such even on the big brand-new ships.

What about taking decisions? when there is no time? Best of all when you have the knowledge a priori. For instance, when you have the idea of how much time is left to flood the compartment. In order to know that, we need to know how much water floods in.

Ok, imagine the situation: Ship is flooding and you,  calculator in your hand, are look through your books searching for a formulae.
Or otherwise: You have a breach of 2m2 below the waterline and still hope to pump it out with the bilge pump.

In such cases having an evaluation before any similar emergency breaks out is much better.

The table below shows the estimated volumes of water ingress (m3/h) into a damaged compartment.

To estimate the time left to flood the compartment, divide the volume of the compartment by the figure taken from the table, then multiple it by the permeability factor (roughly 0.85 for E/R and 0.90 for cargo spaces).

Container service KPI's - Reliability

One of the most important KPI's in a container service is reliability, i.e. probability of the event that delivery is done on time. The recent correction of the 2-year long slump in the reliability could be correlated with the flatting of the tariff rate (figure below).

The factor to effect is the severe competition which drives the container lines to match their clients' need for the parcel supply reliability. As per Drewry's, the reliability champions among container carriers - Hanjin and Maersk, have achieved unprecedented 90%+ benchmark in the reliability of their services against the industry average level of 69%. This blog's post on Maersk Daily may give an idea of the scale of the efforts and investment required to accomplish the feat.

Nichioh Maru: LED, Solar panels and low friction hull. The list is not full

I am proud to present a pure car carrier (PCC) that made the news - m/v Nichioh Maru. Built by Shin Kurushima Dockyard for Nissan she began her maiden voyage on January 27, 2012. This car carrier of 1380 CEU was designed for domestic feeder service between Kanto, Kinki and Kyushu. Owned and operated by Nissan, this ship is the other greener ship following m/v City of St. Petersburg that pursues the Company's zero-emission headway.





One who likes less official visits is recommended reading Bertel Schmitt's report. There are many photos and vivid comments.

I must admit, that besides the advanced engine, LED, solars and super smooth coating Nichioh Maru for me is just the same Japanese style PCC. All in the best simplistic traditions, same cargo decks, same bridge, same accommodations.

Lifetime Career

Here you are a very positive video made by V.Ships, which shows various people and their individual goals that do exist besides the financial benefits to be extracted from the respective jobs. Their is stressed because I always saw my own career as a part of the industry and not vice versa.

I consider this video to have a very strong incentivizing effect and therefore worth viewing more than once.





In the interviews one could find out what the people strive for in their professional lives. For me Magnus Boateng has already carved it out as:
"Reason for me to come ashore I would to say I'd put on down to the desire to acquire knowledge."

Imagine Life is a game...

In a university commencement address at the Georgia Tech 172nd on Sept. 6, 1996, Brian Dyson, former CEO of Coca Cola Enterprises, said:

"IMAGINE LIFE AS A GAME IN WHICH YOU ARE JUGGLING SOME FIVE BALLS IN THE AIR. You name them - Work, Family, Health, Friends and Spirit - and you're keeping all of these in the air. You will soon understand that Work is a rubber ball. If you drop it, it will bounce back.

But the other four balls - Family, Health, Friends, and Spirit are made of glass. If you drop one of these, they will be irrevocably scuffed, marked, nicked, damaged or even shattered. They will never be the same.
You must understand that and strive for balance in your life.

In some internet sources one could find the 'full' text with the following guidance (attributed to Dyson but allegedly originating from the book "Suzanne's Diary to Nicholas" by James Patterson):

I am not a great fan of great quotes and do not accept the guidance as the new testament, especially in savouring The Presence. However, if the Five Balls speech was actually restricted to the goal of 'balance' only, then I do more than applaud to Dyson for his depth of sight and shrewdness in not providing the recipe of keeping the balance. Everyone finds own.

Надбавка за безопасность или за опасность?

По сообщениям газеты South China Morning Post, совет ассоциаций экспортеров Гонконга, представляющий производителей, экспедиторов и торговые палаты, а также отдельные предприятия розничной торговли, логистические компании, производителей и юридические фирмы, обратился к крупнейшим контейнерным линиям за разъяснениями по поводу введения надбавок на противостояние угрозе пиратства для судов, следующих транзитом через Индийский океан и в районе северо-восточного побережья Африки.

В частности Maersk Line подняли уровень безопасности своих перевозок через Индийский океан, Аравийское море и в Аденском заливе, расходы на которые должны компенсировать введённые надбавки (Security Surcharges) от 20 до 50% к базисному тарифу (200 - 500USD).

Кроме Maersk Line подобные меры введены со стороны таких глобальных лидеров как CMA CGM и MSC, ожидается заявление об использовании вооружённой охраны на судах крупнейшего азиатского перевозчика OOCL.

Дополнительная плата начисляется в зависимости от риска по скользящей шкале и предназначена для покрытия издержек на вооруженную охрану судна и комплекс других мер:
  • укрепление периметра судна;
  • обучение экипажа;
  • плавание на более высоких скоростях;
  • охрану портов и якорных стоянок и др.
Можно даже не вспоминать о том, что все расходы в конце концов лягут бременем на конечных потребителей товара.

Подача морского протеста (из лекций по КЭС)

Несмотря на свою важность и частоту упоминания в многочисленных источниках, морской протест остается одним из наиболее загадочных документов в коммерческой практике на борту судна. Не во всех случаях, когда существует целесообразность подачи морского протеста, эта необходимость идентифицируется капитаном, или не во всех случаях, когда все-таки понимают, что следует подавать морской протест, документ составляется и подается своевременно и правильным образом.

В чем заключается смысл подачи морского протеста
Смысл морского протеста заключается в резервировании права воспользоваться оговорками договора перевозки (о действии обстоятельств "форс-мажор", об общей аварии и другими) и в создании доказательной базы того, что перевозчик проявил "надлежащую тщательность".

Содержание морского протеста
Стандартом понятия, содержания и процедуры подачи морского протеста является английское морское право. В большинстве морских стран этот стандарт прижился в виде правовых норм, местных традиций или корпоративных правил. Следуя вышеуказанному канону, документ составляется на английском языке и называется "Note of Marine Protest" или "Sea Protest". Такой документ является декларацией о протесте и регистрируется после ее заявления: местным нотариусом, консулом, магистратом или другим органом местной исполнительной власти. Содержание документа слегка разнится в зависимости от случая, вызвавшего необходимость подачи протеста, но в общем он имеет одни и те же атрибуты:
  • название порта и дата подачи документа;
  • титул документа;
  • название, идентификатор (официальный номер, номер ИМО, позывной), тоннаж, порт приписки и флаг судна;
  • имя капитана, полное название [официального] судовладельца;
  • номер рейса, дата/время и идентификация места события, о котором заявляется в протесте ("по пути из порта ... в порт ..." или "... якорная стоянка на рейде порта ..." или т.п.), дата/время выхода из последнего порта и дата/время прихода в порт заявления;
  • фраза декларации протеста против возможных убытков, описание условий возникновения или причины таких опасений;
  • фраза о резервировании права возобновления указанного протеста в удобные для заявителя время и место;
  • присяга и подпись заявителя (капитана);
  • судовая печать;
  • декларация стороны, перед которой заявлялся протест, о принятии протеста;
  • место и дата принятия протеста;
  • подпись и печать стороны, перед которой заявлялся протест.
К морскому протесту зачастую прилагаются свидетельские показания капитана и членов экипажа (как минимум двух), сводки погоды, копии карт и плана перехода, фотографии, выписки из судовых журналов и другие соответствующие записи, заверенные подписью капитана и печатью судна. При заявлении протеста, капитан должен иметь при себе паспорт или другой аналогичный документ, удостоверяющий его личность.

Как и когда подается морской протест
Технически, по заявке капитана подача морского протеста организуется агентом. Для избежания коллизии интересов в портах, где номинирован агент фрахтователя, рекомендуется обращаться не к нему, а к своему протектинг-агенту.
Протест должен быть подан:
  • в течение 24 часов по прибытии в следующий после обнаруженных во время рейса неблагоприятных событий или условий порт захода; либо
  • в порту, где произошли такие события или имели место события, в течение 24 часов после их обнаружения.
В случаях, относящихся к возможному ущербу грузу, заявление протеста должно происходить до момента вскрытия трюмов (груза).
Если подача морского протеста в связи с праздниками, выходными днями или по другим объективным причинам не происходит, то готовят отдельный документ, указывающий причины такой задержки, и подписывают его у агента или другого свидетеля.

Случаи, когда следует подавать морской протест
Типичные случаи, когда следует подать морской протест:
  1. Всякий раз, когда во время рейса встречаются условия ветра и моря, которые могли привести к повреждению груза (обычно при волнении 8 баллов по шкале Бофорта и более).
  2. Когда вследствие воздействия моря и погоды судно не было в состоянии предпринимать предписанные (инструкциями, хорошей морской практикой) мероприятия по вентиляции скоропортящихся грузов.
  3. Когда груз подается к погрузке в таком состоянии, что, скорее всего, его качество ухудшится, а количество уменьшится в течение рейса. В этом случае, однако, протест не будет эффективным, если коносаменты не будут содержать оговорки, указывающие на состояние груза во время отгрузки.
  4. Когда со стороны фрахтователя или его агента имело место какое-либо серьезное нарушение условий чартера (отказ в погрузке, чрезмерная задержка операций, погрузка неправильно упакованного груза, отказ от уплаты причитающихся фрахта/демереджа, отказ в приеме подписанных капитаном коносаментов и т.п.).
  5. Когда получатели не в состоянии обеспечить выгрузку или приемку груза должным образом.
  6. В случае расхождении цифр по окончанию бункеровки и возможной недостачи бункера фрахтователя.
  7. Во всех случаях общей аварии.
В случае частной аварии по любой причине, когда получило повреждения только судно или есть основания опасаться ущерба только для судна, морской протест не подается, а применяется обычный протест или стейтмент ("Letter of Protest" или LOP, "Statement of Facts" или SOF). В частности, многочисленные письма протеста возникают в практике перевозки нефтепродуктов. Например, когда при сдаче груза терминал и судно расходятся в количестве груза.

Применение морского протеста с точки зрения права
Точность и безошибочность деталей морского протеста имеют огромное значение, в противном случае протест может быть объявлен ничтожным.
По первоначальному смыслу морской протест должен выполнять функции по защите перевозчика от дальнейших претензий фрахтователя или грузовладельца. В этом случае правовой вес этого документа для перевозчика определяется признанием протеста в качестве свидетельства по возможному, в случае подтвердившихся опасений об ущербе, делу в арбитраже/суде. Хотя в английском праве морской протест принимается в суде только в случае согласия на это обеих сторон (истца и ответчика), правильно заявленный морской протест предоставляет перевозчику гораздо лучшую правовую позицию в ограничении или даже снятии с себя ответственности за такой ущерб.
Несмотря на всю важность морского протеста для перевозчика, его основное практическое применение на сегодняшний день - это использование как основания в обращении грузовладельца к своему страхователю за возмещением ущерба, причиненного грузу.
Факт подачи морского протеста заносится в судовой журнал.
